O Tribunal de Justi\u00e7a de Minas Gerais (TJMG) decidiu manter a pron\u00fancia de acusado, que ser\u00e1 levado a julgamento pelo Tribunal do J\u00fari pelos crimes de duplo homic\u00eddio qualificado consumado, al\u00e9m de omiss\u00e3o de socorro e fuga do local do acidente. O caso aconteceu no dia 04 de agosto de 2023 em S\u00e3o Sebasti\u00e3o do Anta, na comarca de Inhapim.<\/p>\n\n\n\n
De acordo com den\u00fancia do Minist\u00e9rio P\u00fablico de Minas Gerais (MPMG), o acusado dirigia um ve\u00edculo sem habilita\u00e7\u00e3o, sob efeito de \u00e1lcool e em alta velocidade, quando bateu violentamente na traseira de uma motocicleta ocupada por Guilherme Luiz Fagundes e Tiago do Carmo Silveira Silva, ambos de 20 anos.<\/p>\n\n\n\n
Com o impacto, as v\u00edtimas foram arremessadas e arrastadas por v\u00e1rios metros, n\u00e3o resistindo aos ferimentos. Ap\u00f3s o acidente, o motorista deixou o local sem prestar socorro e abandonou o ve\u00edculo.<\/p>\n\n\n\n
A defesa recorreu pedindo a desclassifica\u00e7\u00e3o do crime para homic\u00eddio culposo, alegando aus\u00eancia de inten\u00e7\u00e3o de matar, al\u00e9m da retirada das qualificadoras. No entanto, a 6\u00aa C\u00e2mara Criminal do TJMG entendeu que h\u00e1 ind\u00edcios suficientes de dolo eventual \u2014 quando o autor assume o risco de causar a morte \u2014 considerando a combina\u00e7\u00e3o de \u00e1lcool, excesso de velocidade, falta de habilita\u00e7\u00e3o e fuga.<\/p>\n\n\n\n
O Tribunal destacou ainda que cabe ao Tribunal do J\u00fari decidir se houve dolo eventual ou culpa consciente, mantendo tamb\u00e9m as qualificadoras apontadas pelo Minist\u00e9rio P\u00fablico.<\/p>\n\n\n\n
