O Minist\u00e9rio P\u00fablico de Minas Gerais, por meio da 1\u00aa Promotoria de Justi\u00e7a de Inhapim, representada pelos promotores Jonas Junio Linhares Costa Monteiro e Igor Heringer Chamon Rodrigues, obteve decis\u00e3o favor\u00e1vel no Superior Tribunal de Justi\u00e7a (STJ) para restabelecer a pris\u00e3o preventiva de homem acusado de estupro de vulner\u00e1vel.<\/p>\n\n\n\n
O crime ocorreu em 26 de maio de 2024, por volta das 20h54, no Rancho Ponte Alta, em Dom Cavati\/MG. O acusado foi preso em 7 de agosto de 2025, em Ipatinga, no bairro Cana\u00e3, pela Pol\u00edcia Militar, em cumprimento \u00e0 ordem judicial.<\/p>\n\n\n\n
A decis\u00e3o foi proferida pelo Ministro Sebasti\u00e3o Reis J\u00fanior, relator do Agravo em Recurso Especial, que reconheceu a gravidade concreta do delito e a periculosidade do acusado, confirmada pelo modus operandi. O STJ reformou ac\u00f3rd\u00e3o do Tribunal de Justi\u00e7a de Minas Gerais, que havia revogado a pris\u00e3o com base apenas em condi\u00e7\u00f5es pessoais favor\u00e1veis.<\/p>\n\n\n\n
Segundo as investiga\u00e7\u00f5es, os fatos ocorreram durante uma cavalgada, quando o acusado levou a v\u00edtima \u2014 uma crian\u00e7a de apenas cinco anos \u2014 para um local isolado, onde praticou atos libidinosos. Laudo pericial identificou les\u00f5es compat\u00edveis com penetra\u00e7\u00e3o vaginal, refor\u00e7ando os ind\u00edcios de viol\u00eancia sexual. O Minist\u00e9rio P\u00fablico sustentou que a pris\u00e3o preventiva era necess\u00e1ria para proteger a v\u00edtima e a ordem p\u00fablica, pois medidas alternativas seriam insuficientes diante da gravidade do caso.<\/p>\n\n\n\n
O STJ destacou que fatores como resid\u00eancia fixa e aus\u00eancia de antecedentes n\u00e3o afastam a pris\u00e3o preventiva quando presentes os requisitos do artigo 312 do C\u00f3digo de Processo Penal. Assim, foi cassado o ac\u00f3rd\u00e3o do TJMG e restabelecida a decis\u00e3o de primeira inst\u00e2ncia.<\/p>\n\n\n\n
Para o promotor Jonas Junio, a decis\u00e3o reafirma a import\u00e2ncia da firmeza jur\u00eddica, da prote\u00e7\u00e3o \u00e0s crian\u00e7as e da responsabilidade penal em crimes sexuais, sendo a pris\u00e3o preventiva essencial para resguardar a sociedade e a dignidade humana.<\/p>\n\n\n\n
