A decis\u00e3o reformou ac\u00f3rd\u00e3o do Tribunal de Justi\u00e7a de Minas Gerais (TJMG), que havia absolvido o r\u00e9u.<\/p>\n\n\n\n<p>Segundo a den\u00fancia, em novembro de 2018, no distrito de Tarua\u00e7u, em Tarumirim, o acusado criou perfis falsos em redes sociais para obter fotos \u00edntimas das v\u00edtimas. De posse das imagens, passou a amea\u00e7\u00e1-las, exigindo rela\u00e7\u00f5es sexuais sob pena de divulgar o conte\u00fado. Com a recusa, publicou as fotos.<\/p>\n\n\n\n<p>Durante a investiga\u00e7\u00e3o, ficou comprovado que o r\u00e9u usou as imagens \u00edntimas como forma de coa\u00e7\u00e3o para tentar obrigar as v\u00edtimas a praticar atos sexuais. Uma delas relatou ter sido amea\u00e7ada de ter \u201cprints\u201d divulgados caso n\u00e3o mantivesse rela\u00e7\u00f5es com o agressor. A outra foi chantageada a dar um beijo no acusado em troca da exclus\u00e3o das fotos. Essa segunda v\u00edtima acabou tirando a pr\u00f3pria vida ap\u00f3s a exposi\u00e7\u00e3o das imagens.<\/p>\n\n\n\n<p>Em primeira inst\u00e2ncia, o homem foi condenado apenas por divulga\u00e7\u00e3o de cena de nudez (art. 218-C do C\u00f3digo Penal) e absolvido da tentativa de estupro. O MPMG recorreu, mas o TJMG manteve a absolvi\u00e7\u00e3o, alegando que as amea\u00e7as eram atos preparat\u00f3rios.<\/p>\n\n\n\n<p>O Minist\u00e9rio P\u00fablico apresentou ent\u00e3o Recurso Especial ao STJ, defendendo que a grave amea\u00e7a j\u00e1 caracteriza o in\u00edcio da execu\u00e7\u00e3o do crime. O relator acolheu o argumento, reconhecendo que o \u201cestupro virtual\u201d ocorre quando h\u00e1 constrangimento sexual por meios digitais, mesmo sem contato f\u00edsico.<\/p>\n\n\n\n<p>Com a decis\u00e3o, o processo retornar\u00e1 ao TJMG para fixa\u00e7\u00e3o da pena pelo crime de estupro tentado.
