A Justi\u00e7a de Minas Gerais manteve a condena\u00e7\u00e3o de um homem que contou para moradores de Inhapim, no Leste de Minas, que teria descoberto seu pai biol\u00f3gico antes do resultado oficial do exame de DNA. A decis\u00e3o foi divulgada pelo Tribunal de Justi\u00e7a de Minas Gerais (TJMG) nesta quarta-feira (25). Segundo o \u00f3rg\u00e3o, a divulga\u00e7\u00e3o antecipada do resultado causou constrangimento ao homem apontado como suposto pai, que entrou com a a\u00e7\u00e3o.<\/p>\n\n\n\n
De acordo com o TJMG, o r\u00e9u comentou com vizinhos e pessoas da comunidade sobre a poss\u00edvel paternidade, mesmo sem ter o exame conclu\u00eddo. O autor da a\u00e7\u00e3o afirmou que a situa\u00e7\u00e3o virou assunto p\u00fablico e afetou sua vida familiar e sua imagem na comunidade.<\/p>\n\n\n\n
Testemunhas ouvidas no processo confirmaram que a hist\u00f3ria se espalhou pela cidade por iniciativa do r\u00e9u.<\/p>\n\n\n\n
Defesa tentou anular a senten\u00e7a<\/p>\n\n\n\n
No recurso, o homem condenado tentou anular a decis\u00e3o. Ele alegou que n\u00e3o havia provas de que teria divulgado a informa\u00e7\u00e3o e disse que apenas buscava sua origem biol\u00f3gica.<\/p>\n\n\n\n
O tribunal, no entanto, entendeu que o direito de investigar paternidade existe, mas deve ser feito com cuidado e sigilo, j\u00e1 que afeta outras pessoas.<\/p>\n\n\n\n
A 17\u00aa C\u00e2mara C\u00edvel manteve a indeniza\u00e7\u00e3o de R$ 10 mil por danos morais e uma multa de 2% sobre o valor da causa. A Justi\u00e7a afirmou que ele divulgou o caso de forma precipitada e ainda tentou responsabilizar o autor pela repercuss\u00e3o.<\/p>\n\n\n\n
